Welcome to EchoFox, a transcription and summarization service provided directly in WhatsApp. These terms and conditions (the “Terms”) govern your use of the EchoFox service, including the transcriptions and summaries provided to you, and your access to the EchoFox website, mobile application, and related services (the “Service”). By using the Service, you agree to these Terms, and to the EchoFox Privacy Policy, which is incorporated into these Terms by reference.
EchoFox provides a transcription and summarization service through WhatsApp. You may use the Service to send voice messages or forward voice messages to our WhatsApp Business account, and we will promptly transcribe them and return the transcription and summary to you, if requested for audio longer than 30 seconds. By using the Service, you agree to use it only for lawful purposes and in accordance with these Terms.
To use the Service, you may be required to create a user account by providing your name, email address, and phone number. You must ensure that the information you provide is accurate and complete, and you must keep your account information up to date. You are responsible for maintaining the confidentiality of your account credentials, and you agree not to share your account credentials with any third party.
By using the Service, you agree that EchoFox may collect and use non-personally identifiable information about your use of the Service, including but not limited to usage data, device data, and logs. EchoFox may use this information to improve the Service, to develop new features and functionality, and to provide support and troubleshooting.
EchoFox may also collect and use personally identifiable information about you, including but not limited to your name, email address, and phone number, for the purpose of providing the Service, to communicate with you about the Service, and to improve the Service. EchoFox may share your information with third-party service providers for the purpose of providing the Service, and may also share your information with law enforcement or other third parties if required by law or in response to a subpoena or other legal process.
The Service and all content and materials contained therein, including but not limited to text, images, graphics, logos, icons, and software, are the property of EchoFox or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use the Service or any content or materials contained therein except as expressly authorized in these Terms or by the owner of the applicable intellectual property rights.
EchoFox may terminate your access to the Service at any time, with or without cause or notice, including without limitation if you breach these Terms. Upon termination, you must immediately cease all use of the Service and any content or materials obtained through the Service.
The Service is provided “as is” and without warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. EchoFox does not warrant that the Service will meet your requirements or that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
In no event shall EchoFox be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with these Terms or the use or inability to use the Service, even if EchoFox has been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which EchoFox is located, without giving effect to any conflict of laws principles. Any legal action arising out of or relating to these Terms or the Service shall be brought exclusively in the courts of such jurisdiction.
The EchoFox app and all materials, including but not limited to software, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music, and artwork, belong to us or our licensors and are protected by intellectual property laws. You may not use or reproduce any of the materials without our express written consent.
We reserve the right to terminate your use of EchoFox at any time and for any reason without notice, including if you violate any of these terms and conditions. Upon termination, you must cease all use of EchoFox and delete any materials or content obtained through the app.
EchoFox is provided on an “as-is” and “as available” basis, and we do not make any representations or warranties of any kind, express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose. We do not guarantee that EchoFox will be error-free, uninterrupted, or secure, or that any defects or errors will be corrected. You agree that you use EchoFox at your own risk.
To the fullest extent permitted by law, we shall not be liable for any damages, including but not limited to direct, indirect, incidental, consequential, punitive, or exemplary damages, arising out of or in connection with your use of EchoFox, including but not limited to the use or inability to use the app, any content or materials obtained through the app, or any third-party websites or services linked to or from the app.
You agree to indemnify, defend, and hold us and our affiliates, officers, directors, employees, agents, and licensors harmless from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or in connection with your use of EchoFox or any violation of these terms and conditions.
These terms and conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which we are located, without giving effect to any conflict of laws principles. Any dispute arising out of or relating to these terms and conditions or your use of EchoFox shall be resolved exclusively through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in the English language in the jurisdiction in which we are located, and the arbitrator’s decision shall be final and binding.
These terms and conditions constitute the entire agreement between you and us regarding your use of EchoFox and supersede all prior agreements and understandings, whether written or oral. If any provision of these terms and conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. No waiver of any breach of these terms and conditions shall be deemed a waiver of any subsequent breach, and no failure or delay in enforcing any right or provision shall be deemed a waiver of such right or provision. You may not assign or transfer these terms and conditions, in whole or in part, without our prior written consent. We may assign or transfer these terms and conditions, in whole or in part, without restriction.
